Marvin Sanchez Osorto and others filed a lawsuit in U.S. District Court in Grand Rapids alleging that workers were paid weekly flat rates of $400 to $600 for putting in 65- to 72-hour work weeks. "Because these practices have the effect of paying some employees less than the required minimum wage and some employees less than the required overtime rate, as well as constituting a separate failure to maintain records, Plaintiff Osorto alleges that Defendant Grand King Buffet has violated the Fair Labor Standards Act for him and similarly situated plaintiffs," U.S. District Judge Robert Jonker wrote.
