Judge to rule on Scranton's motion to dismiss commuter tax opponents' case

A hearing that will determine whether Scranton can tax commuters to pay for pensions is scheduled to continue this morning in Lackawanna County Court. Senior Judge John Braxton of Philadelphia, who is hearing a lawsuit by 58 petitioners suing to prevent Scranton's commuter tax, is expected to first rule on a motion to dismiss the case.
