California Court Finds Employers Can Seek Evaluation After Employee Returns From FMLA Leave

In reversing a lower court's decision, the Court of Appeal found that an employer that is not satisfied with the certification from the employee's physician can restore the employee to work and then obtain its own evaluation of the employee's fitness for duty.
