Sixth Circuit Allows Expansive Remedies by Awarding Both Disgorgement of Profits and Benefits

In Rochow v. Life Insurance Company of North America , No. 12-2074 , the U.S. Court of Appeals for the Sixth Circuit took an expansive view of the remedies available under ERISA by allowing a plaintiff to recover benefits under ERISA A 502 and also obtain equitable relief in the form of disgorgement of profits under ERISA A 502 .
